1. Definitions
Accommodation: The holiday home or property rented for a set period, including all associated facilities listed in the reservation form.
Accommodation Provider: The party responsible for on-site services such as key handover, cleaning, maintenance, and handling payments due from the tenant.
Booking Agent: The intermediary who processes reservations on behalf of the landlord, including payment collection.
Tenant (Lessee): The person named in the reservation form as responsible for the booking and compliance with the agreement.
Rent: The total price stated in the reservation form for use of the accommodation, which may include extra charges unless otherwise specified.
Booking / Rental Agreement: The binding confirmation of a reservation between tenant and landlord or booking agent.
Reservation Form: The written or digital confirmation of booking details and rental conditions.
Landlord (Lessor): The owner, or their representative, who makes the accommodation available.
Rental Conditions: The rules and terms in this document governing the agreement.
2. Applicability
These conditions apply to all agreements between lessor and lessee, regardless of booking method (online, phone, email, or in writing).
By booking, the tenant confirms acceptance of these terms.
Deviations are valid only if agreed in writing by both parties.
3. Formation of Agreement
A rental agreement is valid once the tenant books and receives confirmation from the landlord or booking agent.
Confirmation may be sent in writing, via email, or automatically.
Tenants must check confirmation details immediately and report errors.
4. Amendments
Changes to the agreement require written approval.
Any cost adjustments will be confirmed in writing and paid by the tenant.
Requests may be refused if impractical or disruptive to the booking.
5. Payment Terms
A deposit (as per the reservation form) is due within 3 working days of booking. Late payment may result in cancellation.
The balance must be paid by the due date listed. Failure to pay may lead to cancellation without refund.
Bookings made less than 4 weeks before arrival must be paid in full immediately.
Deposits are refundable only if cancellation is due to the landlord or agent.
6. Prices & Adjustments
Prices apply per property and per rental period.
The landlord may adjust prices due to taxes, levies, exchange rates, or other external factors.
Misprints and publication errors are reserved.
Price increases within 3 months of booking entitle the tenant to cancel with a full refund.
After full payment, prices remain fixed unless agreed otherwise in writing.
7. Dissolution of Agreement
If the tenant fails to meet obligations, the landlord may dissolve the contract and retain the deposit.
Additional damages beyond the deposit may also be claimed.
Dissolution will always be communicated in writing.
8. Cancellation by Tenant
Cancellations must be made in writing.
Up to 60 days before arrival: deposit is non-refundable.
Within 60 days of arrival: full rent is due.
For bookings made via third-party portals, their cancellation terms apply.
9. Insurance
Insurance is not included unless specifically stated.
10. Liability
The landlord/agent is not liable for loss or damage to tenant property.
Liability for defects is limited to the rental fee paid.
No liability applies for personal or indirect damages.
11. Age Restriction
Groups where all guests are under 30 require prior written approval.
12. Tenant Obligations
Tenant is jointly responsible for the full rental fee and for damages caused by themselves or co-occupants.
The accommodation must be used respectfully; nuisance may lead to termination without refund.
Only the number of persons stated in the reservation may stay. Extra guests require written consent and may incur surcharges.
13. Tourist Register
Tenants must complete the mandatory tourist register accurately and on time. Fines for non-compliance are the tenant’s responsibility.
14. Security Deposit
A deposit may be required and will be refunded (less damages) within 8 days of departure.
All breakages, losses, or damages must be reported immediately.
15. Arrival & Departure
Standard arrival: 16:00–18:00 (unless otherwise stated). Late arrivals must be communicated in advance.
Departure: before 09:30. Late check-out may result in charges or forfeiture of deposit.
On departure, the property must be left broom-clean, with furniture in place, dishes washed, and rubbish removed.
16. Use of Facilities
Tenants must comply with house and community rules (e.g., for pools, gardens, lifts).
Parties or events require prior written consent.
Excessive noise, music, or nuisance is prohibited without permission.
17. Utilities & Energy
Water, electricity, and gas are usually included in the rent unless otherwise stated.
Heating, air conditioning, or abnormal consumption may incur extra charges.
Winter rentals or stays over 28 days usually exclude utility costs.
Charging electric or hybrid vehicles without written consent is strictly forbidden.
18. Garden & Pool Maintenance
Regular maintenance is necessary. Tenants must allow access to staff for cleaning or servicing.
Tenants may not operate pumps, filters, or irrigation systems. Damage due to misuse will be charged.
19. External Circumstances
Construction, utility interruptions, or limited TV channels may occur and are outside the landlord’s control.
No liability for inconvenience caused by third parties or local authorities.
20. Complaints
Issues must be reported immediately to the accommodation provider.
Serious complaints should also be reported to the booking agent.
Written complaints must be submitted within 2 weeks after departure.
Moving to another property or leaving early without consent voids refund rights.
21. Governing Law & Disputes
All agreements are governed by the law of the country/region where the accommodation is located.
Disputes will be settled by the competent court in that jurisdiction, unless otherwise agreed in writing.
